Terms of use and sale
These terms apply to the use of the website www.mosjan.eu and to ordering production services from MOS OÜ. They are also available in Estonian; if the two versions differ, the Estonian version applies.
1. Service provider

2. Services and ordering
- The services described on the website (such as commercials, corporate, event and music videos, films and television programmes) are introductory information, not a binding offer.
- To order, write to support@mosjan.eu. Based on your enquiry we send a quote with the scope, price, dates and other key terms.
- A contract is concluded when you confirm the quote in writing (email included) or when we sign a separate agreement. If the quote or agreement and these terms differ, the quote or agreement applies.
3. Price and payment
- The price of a service is agreed in the quote. Payment is made by invoice by the due date stated on it.
- A quote may require an advance payment. Work beyond what was agreed (such as extra shooting days or additional revisions) is agreed separately.
4. Delivery and revisions
- We deliver the finished work in the format and manner agreed in the quote, for example as a file with a download link.
- The price includes the number of revision rounds agreed in the quote. If the finished work does not match what was agreed, let us know and we will fix it.
5. Copyright and licence
- The rights to use the finished work (where, for how long and for what purpose it may be used) are agreed in the quote or agreement. Unless agreed otherwise, once the invoice is paid you receive a non-exclusive licence to use the finished work for the agreed purpose.
- We do not hand over raw footage (material not used in the finished work) unless agreed otherwise.
- We may show the finished work or excerpts from it as examples of our work unless agreed otherwise.
- If you give us materials for the work (such as a logo, photos, videos or music), you confirm that you have the right to let us use them in that way.
6. Cancellation and withdrawal
- A business client may cancel an order on the terms agreed in the quote or agreement. If work has already started, the client pays for the work done and the costs incurred.
- If you are a consumer and the contract is concluded at a distance (for example by email), you may withdraw from it within 14 days of its conclusion without giving a reason. To withdraw, send us a clear statement at support@mosjan.eu.
- If you ask us to start the service before the withdrawal period ends and then withdraw, you pay a proportionate amount for the service provided up to the withdrawal. Once the service has been fully provided within the withdrawal period with your express consent and your acknowledgement that you lose the right of withdrawal, the right of withdrawal no longer applies.
7. Shoots and force majeure
If a shoot cannot take place for a reason beyond our or your control (such as extreme weather, illness or other force majeure), we agree on a new date. Neither party is liable for a breach caused by force majeure.
8. Use of the website
- The texts, design, logo, photos, videos and other content of the website belong to MOS OÜ or its licensors and are protected by copyright. Copying or distributing the content is allowed only with our prior written permission or to the extent the law allows, such as quoting with a reference to the source.
- The website must not be used in a way that harms its operation or security, such as attacking it or overloading it with automated requests.
- The website may link to other websites. We are not responsible for their content or privacy practices.
9. Liability
Our liability for a breach of contract is limited to the price of the contract, and we are not liable for lost profit or other indirect loss. This limit does not apply to loss caused intentionally or through gross negligence, or where the law does not allow liability to be limited. The information on the website is general, and we are not liable for the website being temporarily unavailable.

11. Changes
We may change these terms. Changed terms apply from their publication on this page. Contracts already concluded keep the terms that applied when they were concluded.
12. Governing law and disputes
These terms and our contracts are governed by Estonian law. We try to resolve disputes by negotiation. Failing agreement, a dispute is resolved by Harju County Court (Harju Maakohus) unless the law provides otherwise. A consumer may also turn to the Consumer Disputes Committee (www.ttja.ee). These terms do not limit the rights the law gives consumers.
